In Manitoba, it is assumed, that unless one or both parties otherwise disclose,
the REALTOR and the brokerage firm representing the seller is the seller's agent and
the REALTOR and brokerage firm representing the buyer is the buyer's agent.

It may arise that [Maximum Realty Ltd] the brokerage also may represent several parties, many buyers and the persons(vendors) who wants to sell their home. [Maximum Realty Ltd] can only continue to represent several parties, when all parties consent to limited joint representation , in which case we must treat both both parties in a fair and even handed manner. We would be unable to represent the interest of either party over the interest of the other.

You hire an REALTOR to represent your best interests throughout the the home buying/selling
process. As my client I represent you personnally in negotiations and am responsible for
the actions and representations made on your behalf. We will complete a written
"Exclusive Buyer Agency Agreement"(for buyers only) establishing our obligations and specifying how payment is to be made. In Winnipeg the MLS® listing contract(for vendors only) allows for payment of commission(sellers) to be made from the transaction, i.e. the money the seller receives for the house.

As your REALTOR I take on the following duties:

    1. Undivided loyalty - to protect your negotiating position at all times, and
        to disclose all known facts that may affect or influence your decision.

    2. To obey all lawful instructions.

    3. An obligation to keep confidences.

    4. The exercise of reasonable care and skill in performing all assigned
        duties.

    5. The duty to account for all money and property placed in our hands while
        acting for you.

THE EXCLUSIVE BUYER AGENCY AGREEMENT
Many REALTORS work with buyers under an agreement much like a Sellers Listing
Contract, when they list a house. Under this agreement the brokerage would be a
appointed your agent with specific duties and obligations. This allows the REALTOR to
aggressively pursue properties that may not be on the MLS® but which may meet your
requirements. As this may require additional expenses and more time, the REALTOR
undertake this knowing that on a successful sale a commission will be paid by the
seller for the services rendered.
